Cancellation Policy
Appointments
Any cancellations with 24 hours notice will not incur a fee.
Cancellations between 12-24 hours will incur a 50% (of the appointment) fee. If this is rescheduled, this fee will be waived.
Any cancelations, or no shows, within 12 hours, will incur a full fee (100% of the appointment).
A small business that generates revenue from appointments will not function without these policies in place. Of course, there are times where this policy will not be enforced, if there is a clear and unavoidable situation, which we will assess on a case by case basis.
Memberships
All membership enquires need to be sent to contact@fullspeed-performance.com
All pauses / cancellations need to be in writing and sent to contact@fullspeed-performance.com
All our memberships have minimum periods, varying between 12-52 weeks.
Our rehab memberships have a 12 week minimum period, whereas our specialised programs will have longer minimum periods:
ACL rehab 12 month membership, 52 weekly payments
12 month upfront membership, one upfront fee

Full Speed Performance appreciate the importance of protecting your personal information and recognise the trust placed in us when you supply your personal information to us. Full Speed Performance will control the collection, security, quality, use and disclosure of personal information in accordance with the Privacy Act 1988 (Cth).

Payment: All payments for sessions are to be made in advance.
Missed sessions: We understand that sometimes you may miss a session. We will do our best to accommodate for your absence. You will not be eligible for a refund for this missed session.
Group Training: If a member of the group cancels or misses an session that group member will forfeit that session regardless of any prior notice given.
Cancelling or missing an screening appointment: If you miss a scheduled appointment or cancel with less than 24 hours notice, you will be charged for the scheduled session (except under special circumstances or in case of emergency).
Trainer cancellation or missing an session: In the event of unexpected absence, your trainer will contact you as soon as possible. If you’re trainer is absent due to a case of an emergency you will be contacted by the Performance Manager to explain the situation and reschedule the session with no penalty to us.
Trainer holidays and absences: Your trainer may have periods of prolonged absence (>14 days). They will be replaced by someone who is trained to take on their responsibilities while they are gone.
Health concerns: You must inform your trainer of any relevant injury or illness and will obtain a medical clearance from your medical specialist prior to beginning (or restarting) training if there are any medical concerns.
Medical freeze option: If you become ill or injured and have been advised by your doctor to temporarily discontinue training, then you may be entitled to a 50% refund for the remaining sessions (up to $100), although Full Speed Performance sessions can accomodate for most injuries and situations.
Refunds: We will not be giving refunds unless specifically organised with the head performance manager. We pay for equipment and staff upfront so it is very difficult for Full Speed Performance to give refunds.
Terms and Conditions: The terms and conditions stated herein will automatically be carried over to your new sessions upon expiry of the current package (Program only or Program + Free screening) without the need for a new agreement to be signed and dated.
Liability: You accept that participating in exercise has a risk of causing injury, both minor and potentially major and that these sessions are to be undertaken at your own risk. YOU ACCEPT THIS RISK AND ACCEPT FULL RESPONSIBILITY FOR YOUR EXERCISE AND TRAINING.
You will in no way hold Full Speed Performance, the facility owners or your trainer liable for any injuries or illness sustained. You also agree that you have no undisclosed injury or illness that may affect your ability to undertake rigorous exercise and to the best of your knowledge you are ready and able to undertake this exercise program and/or screening.

Membership Policy (waiver)
1. Warning and Acknowledgement
You acknowledge that: (a) You have voluntarily elected to participate in personal training and/or group fitness classes (the activity) supplied by Full Speed Performance Pty Ltd and acknowledge the activity involves a degree of physical exertion and/or physical risk; (b) You are medically and physically fit and able to participate in the activity or have received permission from a medical professional to participate in the activity, or you have decided to participate in the activity against or without the advice of a medical professional and in doing so acknowledge that you participate in the activity at your own risk; (c) You will immediately notify Full Speed Performance Pty Ltd in the event of any change to your fitness and/or your ability to participate in the activity, and that any information provided by you to Full Speed Performance Pty Ltd is complete, up to date and accurate at all times.
2. Warranties and Limitation of Liability
2.1 Subject to paragraph 2.2 and to the full extent permitted by the law, (a) except for any warranties specifically set out in this acknowledgement, Full Speed Performance Pty Ltd expressly excludes all conditions, warranties and guarantees, whether express or implied, statutory or otherwise; and b) Full Speed Performance Pty Ltd excludes all liability, whether in contract, tort (including negligence) or otherwise in connection with or arising out of the activity including all liability for any consequential, indirect or special loss or damage, even if Full Speed Performance Pty Ltd was advised of the possibility of such damage, and you hereby release, and will indemnify Full Speed Performance Pty Ltd from and against any claims by any third party for or in respect of such damages. 2.2 Nothing in this paragraph 2 restricts or modifies the application of any consumer guarantee in the Australian Consumer Law or any similar provision in the law of any State or Territory or the exercise of any right conferred under such laws or provisions.
3. Exclusion of Liability for Recreational Services
3.1 Under Schedule 2 of the Competition and Consumer Act 2010 in Australia, and the Australian Consumer Law and Fair Trading Act 2012 in Victoria, there are statutory guarantees that apply to the supply of certain goods and services. These guarantees require Full Speed Performance Pty Ltd to ensure that the activity it provides to you: (a) is rendered with due care and skill; and (b) is reasonably fit for any purpose which you, either expressly or by implication, make known to Full Speed Performance Pty Ltd; (c) might reasonably expected to achieve any result you have made known to Full Speed Performance Pty Ltd; and (d) if the time within the services are to be supplied, are not fixed or not to be determined between you and Full Speed Performance Pty Ltd, that the services will be supplied within a reasonable time. 3.2 You agree that Full Speed Performance Pty Ltd, in respect of the activity supplied by Full Speed Performance Pty Ltd, to the full extent permitted by law, excludes the guarantees in paragraph 3.1 and all liability for: (a) death; (b) physical or mental injury (including the aggravation, acceleration or recurrence of such an injury); (c) the contraction, aggravation or acceleration of a disease; or (d) the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individual: (i) that is or may be harmful or disadvantageous to an individual or community; or (ii) that may result in harm or disadvantage to the individual or community, arising out of or in connection with any failure to comply with these guarantees. 3.3 NOTE: Any changes to Full Speed Performance Pty Ltd's liability as set out in paragraph 3.2 do not apply if your significant personal injury is caused by Full Speed Performance Pty Ltd's reckless conduct.
4. Privacy collection notice
4.1 Full Speed Performance Pty Ltd collects your personal information where it is reasonably necessary for our functions and activities. The kind of personal information we collect about you includes your name, contact details, payment information and health information. Without this information, we cannot provide our services to you. 4.2 We will collect your personal information directly from you, unless it is unreasonable or impracticable for us to do so. 4.3 We will use and disclose your personal information for: (a) the purpose for which it was collected; (b) any related purpose (or, in the case of sensitive information, a directly related purpose) which you would reasonably expect us to use or disclose it for; (c) any purpose required or permitted by law; or (d) any other purpose to which you have consented. 4.4 We will also disclose your personal information to our third party service providers, such as for payment processing, and to our professional advisers. 5.1 I agree to Full Speed Performance Pty Ltd using my photo and/or any videos containing myself for promotional purposes from time to time on Full Speed Performance Pty Ltd's website, social media or other marketing materials created by or for Full Speed Performance Pty Ltd.
